GENERAL TERMS AND CONDITIONS OF PURCHASE

Subject Matter

These General Terms and Conditions of Purchase regulate the rights and obligations of the Merchant and the Consumer in connection with the purchase of goods via the online store www.elipsa.rs, i.e., the conclusion and execution of a distance sales contract, in accordance with the provisions of the Consumer Protection Act, the Trade Act, and other applicable regulations of the Republic of Serbia.

These General Terms and Conditions of Purchase form an integral part of every contract for the sale of goods concluded via the Merchant's online store and apply to all purchases made through the website, unless explicitly agreed otherwise for a specific purchase.

The Consumer confirms that prior to the conclusion of the contract, they had the opportunity to familiarize themselves with these General Terms and Conditions of Purchase, that the terms were made available to them in a durable medium, and that they accepted their contents prior to concluding the contract.

Basic Characteristics of Goods

Prior to concluding the contract, the Merchant provides the Consumer with clear, accurate, and understandable information regarding the essential characteristics of the goods, assuring that the items possess the features necessary for regular use in accordance with their intended purpose.

Essential characteristics are displayed alongside each product in the online store and include, depending on the nature of the product: product name, description, photograph, material composition, dimensions, color, size, technical specifications, instructions for use and maintenance, and other relevant details required to make an informed purchasing decision.

The Merchant takes all reasonable measures to ensure that product information is accurate, complete, and up to date. In the event of an obvious error in the product description, technical details, pricing, or availability, the Merchant reserves the right to make corrections, of which the Consumer will be notified in a timely manner prior to the conclusion or execution of the contract.

Distance Contract Conclusion

The Consumer may place an order via the online store after reviewing all relevant information regarding the goods, price, delivery costs, payment methods, and other terms necessary for concluding the contract.

At the final stage of the checkout process, prior to submitting the order, the total amount payable—including the price of the goods and delivery charges—will be clearly displayed to the Consumer.

By clicking the "PLACE ORDER" (NARUČI) button, the Consumer confirms their product selection and accepts the obligation to pay the total amount specified in the order.

Upon order submission, the Merchant will promptly send an order acknowledgement via email on a durable medium. Following verification and processing, the Merchant will send the Consumer a formal confirmation of order acceptance, together with the Sales Contract and the Withdrawal Form. The sales contract is considered concluded at the moment the Merchant delivers the confirmation of order acceptance to the Consumer.

Note: The initial email acknowledgement of order receipt sent by the Merchant merely confirms that the order has been received and does not constitute the formal conclusion of a distance sales contract. If the Merchant determines that a product is out of stock, that objective reasons prevent delivery, or that an obvious data entry error occurred, the Merchant will notify the Consumer without delay and refund any payments received.

Sales Price, Costs, and Payment Methods

In accordance with the Consumer Protection Act and the Trade Act, the Merchant provides clear and understandable details regarding product pricing, calculation methods, additional fees, available payment options, and performance terms.

All product prices listed in the online store represent the final retail price, including Value Added Tax (VAT), unless explicitly stated otherwise. All prices are expressed in Serbian Dinars (RSD), and all payments are processed in RSD.

Delivery fees and any other applicable additional charges are explicitly shown before the contract is concluded (i.e., before order confirmation), ensuring full transparency regarding the total amount due.

The Consumer may complete payment using the following methods:

  • Cash on Delivery (COD)

    Payment is made in cash (RSD) directly to the courier upon parcel delivery.

  • Bank Transfer / Postal Order

    For payments made via bank or post office transfer, the payment deadline is 3 business days. Goods will be dispatched once the payment is credited to our account.

  • Payment Cards

    Online card payments are processed using supported payment cards (Visa, Visa Electron, MasterCard, Maestro). The card must be enabled by the issuing bank for online transactions.

When ordering online, selecting card payment redirects you to the Banca Intesa payment gateway, which is secure and protected using SSL encryption and PKI systems (state-of-the-art cryptographic technology).

Required card details: Card number, Expiry date, and CVC2/CVV2 code.

Security Guarantee: Data security during online purchasing is guaranteed by the payment processor, Banca Intesa ad Beograd. The Merchant never has access to, nor stores, your payment card details.

Delivery of Goods

  • Delivery Fee: Fixed rate of 630.00 RSD per courier price list (D Express). The shipping cost is clearly stated in your order summary. By placing an order via email/website, you give explicit consent to pay the delivery fees.

  • Free Delivery: For purchases exceeding 8,000.00 RSD, shipping costs are fully covered by the Merchant (Elipsa).

  • Delivery Timeframe: Delivery takes between 2 to 5 business days from payment confirmation or order receipt. This period includes order processing time plus courier transit days.

  • Territorial Scope: Deliveries are made exclusively within the territory of the Republic of Serbia (excluding the territory of AP Kosovo and Metohija).

Receiving the Package

Deliveries are carried out by couriers between 8:00 AM and 4:00 PM. Please ensure someone is available at the provided delivery address during these hours.

Upon receipt, inspect the package visually for external damage:

  • If the outer box is significantly damaged and you suspect the contents might be compromised, refuse the delivery and inform us immediately.

  • If the package appears undamaged, accept the delivery, sign the proof of delivery, and pay the total amount if COD was selected.

Couriers will attempt delivery twice. Standard procedure involves a phone call to reschedule if you are unavailable during the first attempt. If delivery fails on the second attempt, the parcel returns to us, after which we will contact you to determine the cause and arrange re-shipment.

Registration

Purchasing is available for both registered users and guest buyers. To register, fill in the fields on the Registration page and follow the email instructions. Registration is free and only required once; the system will recognize your account automatically on future visits.

Cart & Checkout

Add desired items to your cart by clicking "Add to Cart" (Dodaj u korpu). Click "My Cart" (Moja korpa) in the top right corner to review items, adjust quantities, and enter accurate delivery details. The Merchant is not liable for delivery failures or delays resulting from incorrect or incomplete addresses provided by the Consumer.

Right of Withdrawal

The Consumer has the right to withdraw from a distance contract within 14 days from the date the goods come into the physical possession of the Consumer (or a designated third party other than the carrier), without giving any reason and without incurring costs other than the direct cost of returning the goods.

To exercise this right, the Consumer must submit a completed Withdrawal Form to the Merchant before the 14-day period expires.

Upon receiving the withdrawal declaration, the Merchant will promptly send an acknowledgment receipt. The Consumer must return the goods without delay, and no later than 14 days from sending the withdrawal notification. The Consumer bears the direct cost of returning the goods.

The Consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Refunds Upon Withdrawal

In the event of contract withdrawal, the Merchant will refund all payments received from the Consumer without delay, and no later than 14 days from the date on which the Merchant was informed of the withdrawal decision.

The Merchant reserves the right to withhold the refund until the returned goods are received back, or until the Consumer provides proof of having sent back the goods, whichever occurs first.

Refunds will be processed using the same payment method used for the initial transaction, unless expressly agreed otherwise. By purchasing products, you explicitly agree that cash/bank-based refunds will be credited directly to your bank account.

Item Exchange

Consumers may request an item exchange within 14 days of receiving the product. Exchanges apply to size, model, or color modifications.

  • The returned item must be undamaged and show no signs of wear/use. Otherwise, the Merchant is not obligated to process the exchange.

  • The replacement item must have an equal or higher value than the returned item (with the difference paid by the Consumer).

  • All return and re-shipping shipping costs for exchanges are borne by the Consumer.

Conformity of Goods and Complaints Procedure

The Merchant is liable for any non-conformity of the goods that exists at the time of delivery or appears within 2 years from delivery, pursuant to the Consumer Protection Act.

If non-conformity appears within 1 year from delivery, it is presumed to have existed at the time of delivery, unless this is inconsistent with the nature of the goods or the non-conformity itself.

Filing a Complaint

Consumers can submit a statutory complaint via:

Proof of purchase (receipt copy, payment slip, or invoice) must accompany the complaint.

Processing Timelines

  1. Receipt Acknowledgment: Issued immediately with a tracking/log number.

  2. Merchant Decision: Delivered within 8 days of receiving the complaint, stating whether the claim is accepted, proposed remedies, and fulfillment deadlines.

  3. Consumer Response: The Consumer must respond to the Merchant's proposal within 3 days. Failure to respond within 3 days implies disagreement with the proposed solution.

  4. Resolution Period: Must not exceed 15 days from the initial submission date.

If non-conformity occurs within 30 days of delivery, the Consumer has the immediate right to choose between replacement, a proportionate price reduction, or full contract termination.

The Merchant covers all necessary costs required to bring the goods into conformity (labor, materials, pickup, and delivery).

Out-of-Court Dispute Resolution

In accordance with Articles 63 and 173 of the Consumer Protection Act (Official Gazette of RS, No. 35/2026), Consumers are informed of the availability of out-of-court dispute resolution mechanisms should a complaint be rejected by the Merchant.

Out-of-court proceedings are conducted in a transparent, efficient, fast, and fair manner before an officially designated dispute resolution body. The official registry of entities is maintained by the Ministry of Internal and External Trade at https://www.zastitapotrosaca.gov.rs/.

Consumers may initiate proceedings within 1 year of submitting their initial complaint. As a Merchant, we are legally bound to participate in out-of-court dispute resolution proceedings. Each party covers their own operational costs (legal representation, travel expenses, etc.).

Unfair and Aggressive Commercial Practices

The Merchant operates in good faith, professionally, and in strict compliance with professional diligence requirements.

The Merchant refrains from misleading, deceptive, or aggressive commercial practices before, during, or after contract execution.

Specifically, the Merchant will not misrepresent:

  • Product specifications, materials, availability, or intended use;

  • Pricing, discount structures, promotional offers, or hidden charges;

  • Consumer rights regarding guarantees, returns, or contract withdrawal;

  • Merchant identity or commercial credentials.

Aggressive practices—including coercion, harassment, persistent unsolicited communications, pressure tactics, or false promotional claims—are strictly prohibited and not practiced by the Merchant.

Limitation of Liability

The Merchant shall not be held liable for failure or delay in fulfilling contractual obligations resulting from events beyond reasonable control (force majeure, telecommunication outages, internet network failures, or technical equipment disruptions). In such events, reasonable efforts will be deployed to restore standard service promptness.

This limitation does not affect statutory rights granted to Consumers under the Consumer Protection Act.

Applicable Law

These General Terms and Conditions of Purchase are governed by and construed in accordance with the laws of the Republic of Serbia. Any matters not explicitly detailed herein are subject to the relevant statutory provisions of Serbian law.

Final Provisions

By accessing and using this website, you confirm that you have read, understood, and accepted these Terms and Conditions. Use of the website is permitted solely in compliance with these Terms and applicable laws of the Republic of Serbia.

The Merchant reserves the right to amend and update these Terms. Amendments become effective immediately upon publication on the Merchant's website.
